The Malaga City Council sets the approval of the scooter ordinance for July

Almost two years after the so-called personal mobility vehicles (VMP), with the electric scooter as the main reference, began to take center stage in the capital Malaga, the City Council still does not order their operation precisely. The process of drafting and approving a specific ordinance has almost become an odyssey that, now, seems to be nearing completion.

The Mobility area plans to publish the full text of the new regulations today on the Málaga Contesta portal for fifteen days for it to be submitted to suggestions by interested groups and entities. This was confirmed to this newspaper by the area councilor, José del Río, who indicated that once that period is over and you answer the observations, it will be the moment when the ordinance passes through the Local Government Board and, finally, through the Plenary.

However, and even though the procedures are taking much longer than initially contemplated by the government team, Del Río is confident that the final ratification will take place in the plenary session next July. The only regulation that the capital has regarding scooters is the side that the mayor, Francisco de la Torre, signed in April of last year. In this text, a series of vehicle parking points are delimited, being subject to a fine to leave it in another location.

While waiting to know its content in detail, the objective set by the City Council is to remove the scooters from the sidewalks, minimizing the risk that their circulation implies for pedestrians. Added to this is the obligation for drivers to be equipped with a helmet and reflective vest if they travel on roads of 50 kilometers per hour. Although initially it was intended to avoid its circulation through the basic network, one of the last municipal bets has been to define lanes shared with private traffic but with limited speed.

The minimum age

required to be able to circulate with one of these vehicles is 16 years old. If they are younger, they will have to be accompanied by an adult or guardian. These requirements apply to type A personal mobility vehicles, which include smaller and lighter wheels, platforms, and electric scooters, with a maximum mass of 25 kilometers and one meter in length; and b, which are platforms and electric scooters of up to 50 kilos and 1.9 meters in length. These devices will always have to comply with minimum technical conditions, in the case of brake systems, bell, front and rear lights, and reflective elements.

The City Council also wants to oblige scooter rental companies to keep customer pricing active until stations in designated places or to set up a system that stops the scooter if a driver decides to enter forbidden spaces. They will also be required to have a physical location and a 24-hour mobile phone.

Bogotá wants to revive the reflective vest with a plate for motorcyclists

The Secretary of Security, Hugo Acero, will ask the Congress of the Republic to process a law so that motorcyclists can use the reflective vest with plate numbers on the front and back.

 

In 1999 this measure was implemented to counteract crime, but in 2008 it was no longer mandatory.

 

In Bogotá last year 82,567 robberies were registered, and in 5% of them, there was the participation of criminals on motorcycles.

 

The District discards the restriction to the grill but believes that the use of the reflective vest would facilitate the identification of the motorcyclists and the control.

But a certain set of tools and accessories can be useful to anyone who sets off on a journey, even if it is short and short-lived. Their list was formed based on many years of experience of drivers who got into a wide variety of situations.

 

What is required to carry in the car according to the law?

 

Every law-abiding driver should be aware of the list of items that must always be in the trunk in case of emergencies – as required by the Traffic Regulations. For the absence of any of them, a traffic police officer can issue a fine. However, there is nothing difficult in complying with the requirements of the law – there are only four items on this list.

 

Automotive first aid kit. Perhaps the most important and most useful compulsory subject. Unfortunately, many pay attention to the presence and condition of the first aid kit only when there is an urgent need to use it. Or before a technical inspection, where its contents are checked without fail.

 

The law not only requires a first aid kit but also strictly defines the list of what should be in it. And each of its components must be usable (not expired). On the other hand, no one prohibits and supplementing the mandatory list at their discretion – the main thing is that there are no drugs in the first-aid kit that are prohibited in the Russian Federation. And it is also necessary to use any medicine on other people with an eye to the legislation. We wrote about all this in detail in a separate article.

 

Fire extinguisher. This is also not just an item that must be presented during the inspection or to the inspector to avoid a fine. A fire extinguisher can save not only property but also someone’s life, perhaps even your own.

 

It is important to understand how a fire extinguisher works and to regularly check its expiration date. And also, a fire extinguishing agent must meet certain requirements:

 

for a car, the minimum volume of a fire extinguisher is 2 liters, for trucks – 5 liters;

it is permissible to use only 2 types of fire extinguishers – powder or carbon dioxide;

the fire extinguisher must have a metal body and a spray bell;

powder models must be equipped with a pressure gauge showing the pressure of the filler;

the check of the fire extinguisher must have a whole seal;

 

When sold, the fire extinguisher must be accompanied by a passport with the date of manufacture and expiration date.

 

Warning triangle. This item will not take up much space in the trunk, although its role in preserving people’s health is great: it has repeatedly saved the lives of those who made a forced stop on the road. And the “non-freeze” canister, exposed on the road, will not be an adequate replacement for it.

 

For a triangular warning triangle, there is a regulation that determines the size and design. Thus, the length of each side of the triangle should be 50–55 cm. On the outside, the sign should have stripes of reflective material, each of which is at least 5 cm wide.

 

It is imperative to have special support that will allow you to install and fix the warning triangle sign on any level surface. We, in turn, advise you not to save money and buy the most massive, stable, and strong version – this will not be blown away by a wave of air from the first truck that passes by.

 

Reflective vest. In March 2020, another amendment to the traffic rules introduced a norm according to which drivers, leaving the car, are required to wear a jacket or vest with inserts of reflective material. This should be done on roads outside of settlements in the dark – at night and dusk. And also in conditions of limited visibility. In some European countries, the use of a vest is mandatory regardless of weather conditions.

 

A special GOST 12.4.281-2014 has been adopted, in which strict frameworks are indicated regarding the location and shape of the reflective stripes on the vest. For example, the width of the strip should not be less than 5 cm, and the two main lines must be horizontal and parallel to each other.

 

Unlike other items on this list, even motorcyclists should have a vest. On the other hand, this is the only mandatory accessory for the absence of which a fine is not yet issued.

Electric bicycle or bicycle

Wear warm clothes

Put on layers. On an ordinary bike, you don’t have to bundle up less than on an e-bike or a pedelec, because more heat is produced. When it snows, it is best to wear a waterproof jacket and pants. The snow is melting on your clothes.

 

Think about your visibility

Don’t forget your visibility. Always make sure your front and rear lights are working and a fluorescent jacket is certainly not an unnecessary luxury in winter weather. With a reflective vest, other road users will notice you 150 meters away.

 

How about winter tires?

If the snow persists for a while and you have to cycle a lot, if you are a letter carrier or delivery driver, for example, you might consider winter tires. Not only will they give you more grip, but they will also reduce your stopping distance.

 

Take care of your battery

In cold weather, your e-bike’s battery loses up to 25% of its range. It is best to store your bike indoors and, if this is not possible, store the battery in warmer temperatures. Remember that in freezing temperatures, the battery can be completely discharged within hours without you using it.

 

Electric scooters

 

Monitor your driving style

The small wheels of electric scooters have less grip in winter and the braking is also less smooth. You can wrap colons around your tires for better grip. Look far ahead to better assess the behavior of other road users.

 

Visibility is crucial

Electric scooters are not yet well established, so not all motorists and cyclists can take this into account. Here, too, visibility is a must. Reflective clothing, additional lighting, and fluorescent jackets are more than recommended.

Registration numbers for bicycles. This is what the Berlin police want

The German capital is struggling with the growing number of accidents involving cyclists. The proposed solution to this problem is surprising. As suggested by German uniforms, it would be beneficial to introduce mandatory license plates for two-wheelers.

 

“Because of the growing number of complaints sent by pedestrians, it is worth considering the mandatory marking of bicycles ” – Barbara Slowik, the head of the Berlin police quoated by PAP, told the daily “Berliner Morgenpost”. This postulate was supported by the CDU parliamentary group in the Berlin Landtag. As the spokesperson for the transport of the group pointed out, the idea is to make it easier to bring cyclists who are the perpetrators of collisions to justice.

 

According to the calculations of German law enforcement officers, already over 50 percent. incidents involving cyclists taking place in the capital of our western neighbors are caused by the users of two wheels themselves. According to the police, some of the collisions are caused by cyclists ignoring the rules or aggression on their part. It is difficult to refuse even part of the German police. It has been known for a long time that ignorance and aggression do well under the wings of anonymity. There is, however, the other side of the coin. Many commentators in Germany see the source of the Berlin problem elsewhere.

 

Hendrik Lehmann from “Der Tagesspiegel”, quoted by PAP, notes that the bicycle infrastructure no longer meets the needs of a growing group of cyclists. This is why some of them avoid their designated roads. He also notes that the police have been helpless for years in terms of increasing the safety of vulnerable road users. Finally, he wonders why bicycle license plates should solve the problem when cars with them cause a lot of accidents.

 

According to the Berlin police, in 2019 cyclists only participated in 3.9 percent. accidents in the German capital. For comparison, in Poland in 2019 this percentage was as high as 14.6%. No wonder that we also have voiced about the mandatory marking of bicycles from time to time. The problem, however, is that it is difficult to do it in a way that is both legible and not absurd because your imagination quickly tells you that a bicycle with a license plate would be just like in a car. However, it is a good idea to take out insurance which, in the event of damage to the bicycle, will cover the amount necessary for their removal. Many people already have them – along with an insurance policy for an apartment or a car – without knowing anything about it. A reflective vest with a number is obligatory, the driver is better visible, a large field.

Electric scooters: new obligations but still questions

To end the year and start the next, return, every day, to the articles of the Techni Club, the most consulted cities in 2020 over the months. Today, focus on September, and legal analysis of a decree concerning the use of electric scooters.

New mandatory equipment

A scooter, a Segway, a hoverboard … Since 1 st July 2020, all motorized moving vehicle must be equipped with new equipment:

front and rear lights

rear and side retro-reflective devices

a brake

an audible warning device.

A period had been allowed to allow equipment manufacturers and owners of such machines to equip themselves.

The decree of June 24, 2020, defines the characteristics of the compulsory lighting devices on these vehicles. Note also the decree of the same day relating to the high visibility vest, retro-reflective equipment, and additional lighting device worn by the driver of a motorized personal transport vehicle.

A contravention of 1 st class is incurred for each finding of lighting or signaling defect referred to in Article R.313-1 4 th paragraph (fixed fine of € 11 – NATINF 33348).

The braking device, provided for a new Article R. 315-7 of the Highway Code, is stipulated by the Decree of 21 July 2020. Failure text is sanctioned in a ticket for 1 st class.

Concerning the audible warning device, article R.313-33 of the Highway Code specifies that any motorized personal transport vehicle, like any cycle “must be fitted with a warning device consisting of a bell or a bell whose sound can be heard at least 50 meters away. The use of any other sound signal is prohibited”. The specifics of the buzzer for motorized EDP are specified in the decree of 22 July 2020. The offense is a contravention of 1 st class as for cycles.

New dimension obligations

Since 1 st July 2020, Article R.312-10 of the Highway Code is supplemented to clarify that the maximum width of 0.90 meters for vehicles of motorized personal travel. The same goes for articles R.312-11 which sets the maximum length for motorized personal transport vehicles at 1.35 meters. Failure to respect the dimensions is sanctioned by a 4th class fine (or more depending on the excess for the length).

What compulsory insurance?

If the highway code now has a definition of Displacement Vehicle (EDP) and regulates the traffic conditions of these vehicles, there is still some vagueness concerning insurance. Nothing in the decree of October 2019 refers to the insurance code.

Article L.211-1 of the Insurance Code specifies that “any natural person or any legal person other than the State, whose civil liability may be incurred as a result of damage suffered by third parties resulting from attacks on persons or goods in which a vehicle is involved must, to circulate it, be covered by insurance guaranteeing this liability”. The vehicles concerned are “any land motor vehicle, that is to say, any self-propelled vehicle intended to travel on the ground and which can be actuated by mechanical force without being linked to a railway track” (same article). According to article R.311-1 (6.14) of the Highway Code, since October 2019, the motorized EDP (EDPM) is indeed a vehicle and would therefore be affected by Article L.211-1 of the Insurance Code.

Ministerial confirmation

A ministerial response of February 27, 2020, specifies that “the Government wished to recall the insurance obligation to which users of electric scooters are subject”, unlike non-motorized EDPs such as scooters and electric-assisted bicycles.

Specific insurance?

According to the ministerial response, driving a motorized EDP may very well be covered by the multi-risk home drivers liability contract. The latter would be invited to check that their contract covers the motorized EDP or failing that, to take out a specific contract.

The guarantee by the civil liability insurance (RC) home is however far from being so obvious if one believes the insurance companies ( site of the national association of the users of electric micro-mobility). This point deserves to be confirmed.

What about the insurance certificate?

There is also the question of controlling the compulsory insurance. The Insurance Code provides that an insurance certificate must be affixed to vehicles including two or three wheels. In the latter case, for example for a motorcycle, the two-sided certificate must be visible “on the outside on a surface located in front of the plane formed by the front fork of the vehicles” (article A211-10 of the French Code of insurance). But nothing is said for “home” insurance which would provide coverage (according to the ministry), nor for monowheels which do not include a fork… Consequently, the control seems more complicated for the enforcement officers.

It would be wise to advise EDPM drivers to have proof of insurance with them (as for categorized dogs see page 21 of the 2010 circular ) in the absence of a sticker stuck on their vehicle …

In any case, the control can only be done in the presence of the owner or the driver of the EDPM, since there is no registration for these vehicles. Article 18 of the 2019 decree specifies that the provisions of article R.322-1 of the highway code do not apply to motorized vehicles which are therefore not subject to any obligation of registration.

Do you travel on a motorcycle? Tips for safe driving

Next, we offer you some recommendations to have a safe motorcycle trip:

 

Helmet use

Although it is the most obvious recommendation, it is important to note that 28% of motorcycle riders misuse the helmet, either by not wearing it or by using it incorrectly. It is the most essential element to operate a motorcycle and the one that is least used.

 

According to the World Health Organization, wearing a helmet reduces the risk of death by 40% and serious injury by 70%. Its correct use is key to safe driving.

 

When choosing a helmet, keep in mind the following recommendations:

 

Smooth, hard exterior with retro-reflective markings.

Internal filling not less than 25 thousandths of a meter

Flexible padding attached to the padding, which adjusts the helmet to the head, that is, that is for your size.

Belt retention system and buckle of two-hundredths of a meter minimum width that passed under the chin correctly fasten the helmet to the head.

Polycarbonate visor, preferably anti-fog to prevent fogging.

That the helmet is approved by IRAM standards, that is, that it was subjected to a series of processes and tests aimed at verifying that it meets all the necessary basic safety features.

If the helmet suffers an impact, you must change it because it loses effectiveness.

 

Driver and passenger position

The rider must adopt a posture that allows him to be in control of the motorcycle. Ideally, the hip should be as close to the fuel tank as possible and the knees should lightly press the tank. At the same time, the feet must be on the pedal.

The passenger also has to put his feet on the pedal and must be supported by the driver’s waist. Also, it must accompany the movements of the driver without intervening in the maneuvers.

Visibility

 

The blind angle when we ride a motorcycle limits our rear lateral vision and is often the main cause of many accidents.

 

The riskiest moments occur in lane changes, in traffic situations, or when a car behind us performs an unsigned or unforeseen maneuver. Some of the more experienced motorcyclists know how to avoid the blind spot by looking back quickly when changing lanes, but it is something that for a fraction of a second forces us to take our eyes off the road.

 

The best way to ride a motorcycle is to look at the rear-view mirrors frequently to have greater control over the rest of the vehicles on the road. Although many motorcyclists are reluctant to use the rearview mirrors, it is essential to incorporate them during driving, as they will give us an overview of what is happening behind us. Also, we must signal all the maneuvers that are carried out to warn the rest of the drivers of what we will do, either with the lights or the horn.

 

Driving

In a curve the idea is to adjust the speed before entering it, not to use either brakes or clutch to achieve greater grip.

Braking. Simultaneously apply brakes progressively, without clutch action to take advantage of the engine brake, while kneading the tank and maintaining the posture.

If it rains, it will be better to wait 10 to 20 minutes to get out, once the rain stops. This is to have more adherence.

At night it is advisable to wear light or reflective clothing with reflective fabric since the important thing is that the rest of the vehicles can see the motorcycle and the driver.

Electric scooter use newly regulated by law

At the turn of the year, a new law on the use of electric scooters came into force in Spain, including the Balearic island of Mallorca. This includes, among other things, an adjustment of the maximum permitted speed of the scooters. This is now 25 kilometers per hour.

 

In addition to the new speed limit, there will be other rules for e-scooter drivers to observe in the future. It is now forbidden to drive on sidewalks, promenades, and in pedestrian zones. Furthermore, drivers of e-scooters must also adhere to the applicable traffic regulations, as do other vehicle owners.

 

Extended rules in Palma de Mallorca

 

Since the beginning of November 2020, Mallorca’s capital Palma de Mallorca has had its regulation on the use of electric scooters to avoid accidents. Drivers have to drive with lights not only at night but also during the day. Clothing with reflective elements, such as a safety vest, must also be worn while driving. It is also forbidden to use the scooter in pairs. This also includes taking a child with you. The minimum age for driving an electric scooter is 15 years. The Palma regulation also recommends wearing a helmet. However, this is not expressly required.

 

No cell phone on the scooter ride

 

In general, it has also been the case since 2019 that electric scooters are only allowed to drive in 30 km / h zones and on bike paths. The use of main roads is taboo. Listening to music on the scooter ride is not permitted, as is the use of the mobile phone. Rental in public places and paths is prohibited in Mallorca’s capital. The alcohol limit that applies to driving other vehicles also applies to driving a scooter.

As a pedestrian you pay a fine for everything

According to the St. Gallen canton police, there is often a lack of clarity as to what rights and obligations pedestrians have in traffic. They provide clarity in a recently published guide.

 

Where do pedestrians have right of way?

People who are on foot in road traffic have right of way on pedestrian crossings, sidewalks, and footpaths that are marked with a blue mandatory sign. Every child knows: “I have right of way on the pedestrian crossing!” But suddenly crossing the street on a pedestrian crossing without waiting for an approaching vehicle to stop is not only inconsiderate but also dangerous. And it is also important for pedestrians to wear reflective vests in the night or dark time.

 

In meeting zones, pedestrians always have right of way over rolling traffic. This also applies when crossing the street. This looks different with 30 zones. “Pedestrians are generally allowed to cross the street anywhere, but they must give way to the vehicles on the street,” says the guide.

 

Behavior at the pedestrian crossing and light signals

According to the police, abruptly entering the pedestrian crossing without taking into account the rolling traffic can also be viewed from a legal point of view as “enforcing the right of way”, which is a violation of road traffic legislation. If the lane is crossed next to the pedestrian crossing, this could be punished with a fine of ten francs. This rule applies up to 50 meters before and after the pedestrian crossing. The same rules apply to pedestrian crossings and underpasses.

 

According to the police, it happens again and again that people in their motor vehicles are distracted while driving. “If someone enters the pedestrian crossing at this point, dangerous situations or even accidents can occur,” says the guide. Entering the road, for example behind a bus stopping or parked vehicles, is similarly dangerous.

 

Traffic lights also apply to pedestrians, at least those that are intended for such. Entering the lane when it is red and ignoring the light signal can be punished with a fine of 20 francs. “So it is not only worth waiting for the green phase of a light signal for safety reasons,” said the police.
