Yellow vest with motorcycle: Cuckoo, here it is again

When the summer torpor does not serve as an excuse to pass a law discreetly, it sometimes brings up in some media astonishing questions. You thought it was definitely buried since last year. More tenacious than a Z-series zombie, the fluorescent vest remains a subject apparently vital for some. The proof with this poll RMC and BFM TV appeared yesterday. Do not suffocate yourself by reading his utterance, made almost false by a timely omission.

Fluorescent vest mandatory for all according to RMC and BFM TV

“The yellow reflective vest is mandatory for motorists, not for motorcyclists, contrary to what our German, Belgian, or Italian neighbors do.” Playing on words, this survey clearly suggests that it is necessary to make wearing a yellow vest mandatory for French bikers, some of whom have been dreaming since 2011. By citing Belgium or Germany, the amalgam is all the easier to do that on our roads, it is not uncommon to meet bikers in these countries wearing fluorescent equipment (helmet or jacket). However, they do this only by choice, the German and Italian legislation requiring the transport of the vest under the saddle to be able to dispose of it in case of breakdown, not its permanent wearing.

A proposal made last year by the CNSR with a threat of a fine of 35 € in case of non-port after the tragic-comic saga of the armbands and 150 cm² retro-reflective that had to be imposed – by day – motorcyclists and scooters. It will be recalled that the wearing of the retro-reflective vest is mandatory for cyclists traveling at night outside an agglomeration, the headlights and lights available on a bicycle are not very effective to be as visible as are these elements on a car or a Motorbike. On the other side of the Channel, high visibility vests are also used for all kinds of things.

Road safety: pay attention to the accident

The over-accident is the cause of many deaths on the roads each year. This double drama can be avoided by respecting the safety instructions, in particular that concerning the wearing of the yellow reflective vest.

On the Internet, the Gendarmerie reports two recent events to raise awareness. Last week, in the Nerve, on the A77, a heavy truck came crashing into a van of gendarmes of a Road Safety highway platoon, but also a van of the interdepartmental direction of the roads. The three gendarmes and the patrolman managed to hide behind the guardrails; however, a serious injury was reported.

The previous Sunday, in the Gironde, on the N89 between Bordeaux and Lilbourn, a vehicle carrying six people from the same family is forced to stop on a band of emergency stops following a fuel outage. The whole family straddles the guardrail for shelter, but finds itself near an unlighted side road. In the rain, a 10-year-old girl is then hit by a motorist. She will die in the night following her injuries.

Two facts not so different: in the event of an accident, it is imperative to remain vigilant and respect the instructions of road safety, the wearing of the fluorescent vest, the setting up of the warning triangle, the list not being exhaustive.

Driver license, safety vest and warning triangle for car

It is not enough to have your driver’s license, insurance certificate and registration certificate to be in good standing. Are you driving in a car? Check that you have a fluorescent safety vest and a warning triangle, which are required in the event of an accident.

And no question of letting your vest in your trunk, “The driver shall wear a high visibility vest when he is required to leave a vehicle stopped on the road or its surroundings following an emergency stop. Handy, “says a decree of 29 September 2008. The warning triangle must be positioned thirty meters from the obstacle to be signaled. “The obligation to set up the triangle does not apply when this action constitutes a manifest risk of the driver”, nuance the decree of September 30, 2008. Nothing specifies the place where should be the triangle of signaling when you do not need it.

You risk a fixed fine of 135 Euros -90 Euros in case of quick payment, in the absence of this equipment. If Article R. 234-7 of the Highway Code requires drivers to “justify the possession of a breathalyzer, not used, available immediately”, nothing sanctions it. The spare wheel and the repair kit are not mandatory. Rest assured, you do not need to have a warning triangle… especially if you do not have the necessary storage space.

The reflective vest is mandatory, whether you wear it or it is stowed. The driver of a “vehicle with two or three motorized wheels or a motor quadricycle without bodywork must have this vest on him or in a storage of the vehicle”, approves article R. 416-19 of the Code of the road. Wearing the helmet -with a chinstrap closed-is mandatory, as is the seat belt. You expose yourself to a withdrawal of three points and 135 Euros fine. Your helmet must be homologated and must have four retro-reflective stickers.

Approved gloves are also needed. In case of forgetfulness, you expose yourself to the withdrawal of a point and to 68 Euros of fine -or 45 Euros if fast payment-. Cyclist, you must have a fluorescent vest. The port is mandatory out of town, at night or in case of insufficient visibility. Children under 12 must wear a helmet. In case of non-compliance with this obligation, “adults carrying or accompanying children may be punished by a fine provided for the contraventions of the fourth class” (a fine of 135 Euros reduced to 90 Euros if you pay right away).

Your bike must have lights, yellow or white at the front and red at the back. A buzzer, which can be heard at least 50 meters away, is also necessary. In case of absence, you risk a fine of eleven Euros.

The reflective belt soon be mandatory in school transport

No mandatory belt and reflective vest, more than 3,000 student’s ghosts or the lack of escorts. The safety Critical in school transport rain. The Walloon MP MR, Valerie De returned to the charge in Parliament to the Minister Antonio Di Carlo (transport and mobility).

For the liberal parliamentarian, it is essential “to drastically improve the security of school transportation.” Four points need to change to improve the safety of school transport. First, it’s compulsory wearing of seatbelts. Second, impose the presence of a fluorescent vest in each bus for each child. Third, set up an evacuation plan for school buses and ensure its effective communication to users. Fourth, provide continuously children a secure waiting area.

In Parliament, she questions the minister on the four proposals discussed above. “Sir, can the minister tell me where he is in this thinking? Are there a project to improve safety inside but also outside the school bus?”

Minister Di Carlo Antonio (HRC) said that various Tec have conducted here and there some actions to improve the situation.

These include the training given in schools. “During this initiation, an instructor teaches students including the proper way to evacuate a large size vehicle. Emergency plans in coordination with the emergency services were set up in two provinces, and a third experience in preparation “, said the minister.

Regarding the reflective yellow vests, Tec, with the approval of the Minister, has opted for a smaller model, the reflective armband. It will be provided “to pupils attending school routes, as part of an awareness campaign on how to equip when traveling in the dark.”

The Minister concluded that security will be strengthened in the new specification, “including imposing the compulsory wearing of seatbelts.”
